umm ... what I ment was not "what" they tried to download ... it is the act in
itself... the act of d/l, so to speak

now, I think that is not really allowed... I can agree to "bend the truth", but if
the authorities fall to pure utter lieing it could cause a liability case in
court... authorities backbone lay in the fact of having facts supported by truth
backed by laws and regulations.
Now, let's pretend you come by my username while searching for something specific.
That would be ok as long as you are not from any law inforcement agency anywhere
in the world and you are only out for the purpose and intent of making it possible
prosecuting the owner. If that is the case, it is in fact illegal for you to be

download from me:

Now, if I made this and made it appear before the actual downloading started, then
the user downloading from me would at least have been given a fair warning first
and also been made aware of the fact that by doing it they had agreed to
participate in something they thought of as being illegal and by this creating a
case of liability ...
