The newer I-Pod's don't properly support VBR MP3's either. It is a known bug in the CPU management algorithms on the newer I-Pod's.
Rest assured though, that VBR is part of the MP3 ISO standard. So if your player doesn't play VBR MP3's properly, you know your player is lousy; return it and hope that the next one you try is better.
... Some minor trouble seeking in VBR MP3's is normal on MP3 players.
