Depends a lot on where you are.

In the US if you get caught you can wind up with a huge fine. Local guy
here was in the news with a $600,000 judgement against him cause his
grandkids downloaded some movies. It is generally a copyright
infringement case in civil court rather than a criminal matter.

Depends on how clever you can make the software. If you can set up an
anonymous gateway you should be home free, unless the gateway site logs
your activity, or your local ISP is monitoring.

How lucky do you feel ?

There are some sites now which claim that for a monthly fee you can get
legal downloads of music and movies.
