Users prior to Jan '05 are entitled to compensation if they agree not
to file suit. There still is the possibility of a false advertising law
suit as long as one does not opt for compensation. However, the current
compensation (one month free upgrade) is being contested as
insufficient. A ruling should be made next week.
Subscribers prior to Jan '05 that don't agree to the settlement are
still eligible to file suit for false advertising as are any state DOJ.
Users are not automatically receiving coupons, they must register a
claim.
So according to your own admission (see below): Subscribers prior to
Jan '05 are beholden to neither a disclaimer nor a settlement and
therefore any subsequent lawsuits are legitimate.
