Perhaps this is why there are thousands of copyrighted videos on Youtube,
the uploaders don't like the law and because there are so many people who
are breaking the copyright laws, they might feel there is safety in numbers.
After all, if Youtube will remove inappropriate videos when requested to do
so by the rights owners, then the owners are unlikely to spend a lot of
money taking legal action against thousands of uploaders who broke the law
in the first place.

In my humble opinion, sites like Youtube benefit hugely from sitting back
and letting the uploaders take all the legal risks, what a great position to
be in! The value of Youtube has probably been increased massively because of
all the visitors who look at videos that have not had copyright clearance.

You know, with the law as it is at present, dozens of similar video sharing
sites are likely to be established. After all, if the uploaders take all the
risks, and all the site owner has to do is to take down a few video clips
when requested to do so by the copyright owners, what is there to lose? What
a wonderful setup, the uploaders take all the risks, and the site owner
takes all the benefits (or so we are told).

The site owner doesn't even give an opinion to the uploader on whether a
particular video should be copyright cleared before uploading. So if you are
not sure whether your video of the kids singing "happy birthday" needs
clearance from the music industry, you take all the risks of being sued if
you upload it. Yes, I have heard that even the song "happy birthday" needs
copyright clearance, so I'm not sure where the "fair use" principle comes
in?
