Percentage-wise the incidence is very low but if you download a very large
number of files - such as with still pictures - you are almost certain to
encounter at least a few of them. I am guessing people deliberately mislabel
certain files in order to avoid detection at home then inadvertently upload
the same files without realising it. I've been told by a lawyer who
specialises in this subject that ignorance of the contents of a file is not
a defence in court against a charge of having downloaded it and I know of an
actual recent case in which a foreign exchange student was jailed for 12
months for having had just five illegal files on his PC out of a total of
17,000. His sentence was probably reduced on appeal (they seldom report
that) but personally I would rather not take the chance.
