No he isn't. To make a copy for any reason whatsoever you need the
copyright owner's permission. And as they specifically write on the
disc and packaging that any copying is prohibited then you can't. Simple
as that. And no, I have no intention of getting into any conversations
on the matter. If you think otherwise then you're ignorant of the law,
that's all there is to it.
