look up fair use, it doesn't include distributing programs in their

So is unlicenced distribution. Denying a profit to the copyright
holder is piracy as well. Are you suggesting that if I steal your car
and give it away that it's not theft because I didn't make a profit.

You should take your own advice. Illegal distribution does not require
the illegal distributor to make a profit.
