As far as I'm aware, it is _he_ who needs to make the claim at the PO.
Afterall, the "contract" is between him and the PO.
They (the PO) won't deal with you.

He needs to take it back, refund the money and make his own arrangements re:
repair/refund from the PO and/or write-off. He might be able to have it
fixed, then back to you... (don't let him draw it out for more than 30 days
since the purchase though or you won't be able to complain).
Otherwise he is a bad ebayer and deserves a big NEG.

....best contact ebay somehow too though, in case they can help if he decides
to neg you back.
(not sure how helpful they will be in that case though)
