Not valid. The last time the state militias were called on to protect
the American way of life, Lincoln had conscripted those in the North,
and those in the South lost the War.
It takes direct tyrannicide to work. Set up a Grand Jury made up of
members chosen from the several states at random, and give them the
power to indict any demagogue. Then set up a tribunal with members
from the several states chosen at random. If they convict the bastard,
he hangs in front of the Capitol steps.
Even if he escapes being convicted, the information about him that is
made public will be enough to make him leave the country.
