I would consider it highly unlikely that that particular part of the
law will be upheld by the Supreme Court. It's still up in the air,
legally.

For example, I read that the latest ruling regarding DVD Decrypter
(which is nowhere near the Supreme Court, yet) states that it's legal
to use it to make backup copies, but not legal to distribute it.
Fortunately, of course, it can be distributed by non-U.S. sites.
