The only "correct" answer would be the decision of the court
in a case brought against him by the copyright holder.

Assuming one isn't insane enough to WANT to go to court as
the defendant to get the "correct answer", the next best thing
is the informed opinion of someone who spends a lot of time in
those courtrooms dealing with those kinds of copyright cases.
Perhaps even someone who will back up their opinion as your
legal counsel.

Do you know anyone else who fits that description? I don't.
