The broadcast flag has long since been "bypassed", since it is merely a flag,
not an encryption. You can get many different kinds of recorders for US
digital TV (which is the only thing the broadcast flag affects) that pay
no attention to the flag. Even if BF legislation is enacted, this will
always be the case, although the non-compliant tuners may technically be
illegal to sell.
