No DVD recorders sold in the US can record HDTV, and can only record
digital TV if it is converted to analog first, so the broadcast flag
rules don't apply. Any "flag disable technology" is unrelated to the
broadcast flag.

Since the specs for the broadcast flag weren't created until last year, this
should be your first clue that you are comparing apples and oranges.
