I don't remember the percentage but probably half of the broadband
access in the US are ADSL and they don't provide the kind of max
downstream data rate like 4mbps. For these subscribers, it will take
them overnight (conveniently) to download a DVD quality movies.

Yes, the max downstream rate depends on the distance to CO. Most
providers limits the bandwidth mainly due to their network bandwidth
constraints, not the limit of the twisted pairs. However, in some
states where the qualities of the phone lines have been badly laid out
over the years (i.e. many bridge taps and long phone lines to homes),
people are forced to use cable modem (like me).

Cable video signals are broadcasted to every subscribers and do not
compete with the "individual" internet data that you talked about. If
everybody in your local cable modem area are downloading movies at the
same time, you WILL experience lower downstream rates. However,
downloading movies are not that common yet.
