As NRen pointed out, I am questioning the sample rate.

Download encspot
http://www.guerillasoft.co.uk/encspot/index.html
(regulars note new URL).

This will show you the sampling rate. It may also give you a clue as to
what is different about the troublesome mp3s.

In Lame you would convert sample rate by using --resample 44100
in the command line.
