You are simply wrong in law. Possession of a pirate CD is a breach of
copyright, actionable for damages under civil law. Distribution is a
criminal offence as you say.
Whether anyone has been sued (not arrested or prosecuted - because
those actions apply to criminal law) for possession is an entirely
different matter. Copyright holders find it more effective to go
after the distributors.
