Yes you can time shift, however the production of a recording and
giving it to your friend is still illegal, having the means to do it,
and it being legal are two separate things. The fact that no one cares
if you give your buddy a copy of the porn show you taped last night,
does not, in fact make it legal. Showing the copy to your buddy is
also a lot different than distributing it to thousands of people via
the internet.
Tell you what, set up a home video duping studio and advertise that
you are going to give away discs of the stuff you copy. you'll soon
find that someone may be interested in your less than legal
activities.
BTW the legal right to time shift, and fair use doctrine are in fact
two different things. so before you talk more about fair use and time
shifting, you should maybe actually look up what you are talking
about.
