Personally, I would be lodging with both paypal and ebay. But, Im sure
there is a caveat in there about no refunds for goods as described -
so Im not entirely sure how you go on this.
Thing is, making you wait that long is IMHO not making enough effort -
and looks very much like a stalling tactic. Informing both ebay and
paypal of this will no doubt help your cause.
But in any event - dont delay.
BTW how did you pay? Did you use your CC to pay through PP? If so, get
them involved. (Though I expect you havent used a CC - so not valid!)
