I think that the way you avoid the possibility of prosecution, is to do
what YouTube did. People who post things should be willing to guarentee
that they have the rights and if the owner of the site finds out
otherwise he certainly demonstrates acting in good faith by reporting
the violation. I don't know if that relieves the site owner from
liability, but acting responsibly should count for somthing.
