European authorities who are in a knot over iTunes DRM are not
addressing the interests of music pirates. Au contraire, they are
concerned with the restrictions that prevent persons who *buy* content
from the iTunes store from listening to it or viewing it on players
other than the iPod.
Here is an illustrative case: I have, in addition to my five iPods, a
Pioneer Inno portable XM Radio cum MP3 player. I buy a lot of music
from the iTunes Store and other on-line sellers; I don't steal music. I
usually use the Inno in my car. Sometimes I want to listen to iTunes
music from my iPod in my car. In that case I have to carry two devices
where one -- the Inno -- would do if the iTunes music had no DRM
"protection." It's not moral qualms or fear or the law or the RIAA or
anyone else that prevents me from moving my iTunes music to the Inno --
I have a legal right to listen to music that I have purchased in any
way I want, regardless of what the RIAA might say*. What keeps me from
doing that is the hassle and time required to fuss with DRM busting.
In any case, the music industry /will/ ultimately give up on DRM,
because they, too, know that trying to enforce DRM is an exercise in
futility. Let them put their heads together and find a new business
model.

you were the BIAA and Mom and Pop and the two kids all wanted to read
the latest Harry Potter you would try to make them buy four copies. If
you were the TIAA the family couldn't gather 'round the TV to watch the
Super Bowl. Mom and Pop and little Billy and sister Sally would have to
gather around four different TV's connected to four different cable
installations. "Billy, stop glancing at Daddy's TV -- it's the same as
yours. Do you want us all to end up in jail?"
