Correct. That same argument was what "Universal" tried to use in Sony v.
Universal, but the court ruled that since the content is essentially being
given away (OTA TV was the medium then), temporary copying for timeshifting
purposes was protected.
If you don't own one legitimate copy, then "fair use" might apply, but
certainly not for a full, complete copy. I suspect that you'd have no
problem defending renting DVDs, snipping out a scene or two, and then using
those in some sort of critical (or scholarly) piece that wasn't for profit.
