I'm not convinced that the Betamax Law will be an obstacle. What
the Betamax ruling really came down to was that Sony wasn't liable
for any lost revenue for the studios because consumers used a
Betamax to record something for time shifting.
It doesn't, however, require broadcasters to transmit a signal that
is recordable. Embedding broadcast flags into a TV signal isn't any
more a violation of the Betamax law than HBO scrambling their
downlink signals.
