It's not a straight crop, as the image is opened up on the top and bottom
slightly, and the image pans left and right as needed to keep the pertinent
information in frame.
It's unknown who actually supurvised the transfer, but it seems to have
been done by the production company, as all the DVD releases so far have
used this same master. Even the UK DVD, which has a "scope" aspect ratio,
is just a vertically cropped version of the already altered master.

Note that Terry Gilliam claims he is trying to fix the problem, and
Thinkfilm has said they'd re-issue the film on DVD in the US once they get
the proper image, although it's not clear if Thinkfilm will offer a disc
replacement program for thos who've already bought the disc.
